AG Labrador Begins Investigation Into Caldwell School District’s Proposed “Gender Identity Policies” — More Schools Implicated?

Caldwell School District has been mired in chaos and controversy since they announced that they are considering adopting new policies on “Gender Identity” and “Sexual Orientation.”

When Parents showed up to express their dismay at the new policies, the liberal board of trustees shut down the meeting, because they didn’t want to hear from people like Senator Chris Trakel, who are opposed to the new policies.

Now, Idaho’s new Attorney General is stepping into the ring, saying on Twitter that he will be launching an investigation into the controversial new policies, which he believes may “violate Idaho law.”

In a response to a letter from Debbie Critchfield, the State Superintendent of Education, Senator Cindy Carlson (LD-7) issued a statement corroborating Labrador’s allegation that the proposed “gender identity” policies are in direct conflict with Idaho Law.

Sen. Carlson warned Superintendent Critchfield, saying:

“Your office should take action immediately and remind school boards that enactment and enforcement of these policies may subject them to criminal charges under Idaho law. Every person who exposes his or her genitals in a place where another is offended thereby is guilty of misdemeanor Indecent Exposure. Idaho Code 18-4116(1). Anyone who assists or encourages such a demonstration of genitalia is guilty of the same. Idaho Code 18-4116(2).”

Idaho’s liberal-leaning State Superintendent of Education, Debbie Critchfield, had previously said that schools would “adopt policies that some patrons find objectionable” to prevent “federal investigation and legal action.”

Senator Carlson Shot Back:

“While fear of an overreaching federal government may motivate school districts to accept these policies, protection of children should be our primary concern. Our constituents deserve courage from you and me in defense of their children.

… school districts should not accept these policies due to fear…

We need to send the message that we want to educate the kids of Idaho not indoctrinate them with this garbage.

Let us not forget, our most important job is to protect kids!”

According to watchdog group Eyes in the Classroom, over 27 School Districts and 14 public charter schools in Idaho have already adopted the Idaho School Board Association’s controversial “Gender Identity” policy.

Take, for example Teton, or Kootenai School District’s Policy 3281, which is almost identical to the policies under consideration at Caldwell Schools.

“Students will be allowed to use the restroom and locker room that corresponds to the gender identity they consistently assert at school. No student will be required to use facilities that conflict with his or her gender identity consistently asserted at school.”

The Idaho Tribune reached out to Attorney General’s office asking if his statement also applies to the other 27 school districts in Idaho.

A representative from the AG’s office told the Tribune that “all school districts should ensure their policies are consistent with state and federal law.”

Below are the Idaho School Districts that have already enacted the policy.

This evening, the Caldwell School District Board of Trustees will be holding a workshop and meeting in executive session to “discuss the legal ramifications of and legal options for pending litigation, or controversies not yet being litigated but imminently likely to be litigated."
